In Western Australia a periodic tenancy rent may not be increased within the first six months of the tenancy. After that, increases can occur every six months and landlords must give at least 60 days notice in writing using one of the forms below.

  • Read through the form thoroughly

  • Give the completed form directly to the tenant or send by post

Tips

  • Rent in a fixed-term tenancy can only be increased if the written agreement specifies how much the rent increase will be or the method of calculating the rent increase is shown (eg by CPI). If the rent is able to be increased, it can take effect no sooner than six months after the commencement of the tenancy agreement and the date of the last increase. The lessor must give at least 60 days’ notice of the increase.

In South Australia lease agreements that started on or after 1 March 2014 rent can be increased 12 months from the date of the last rent increase or 12 months from the date the agreement started as long as 60 days written notice is given.

A tenant has a right to reasonable peace, comfort and privacy during the tenancy. The property owner/agent must not interfere with a tenants ‘quiet enjoyment’ of the property. This means that a property owner/agent cannot come onto the property whenever they choose. Certain rules apply when visiting the property.

  • It is always a good idea to chat to the tenant and negotiate a time that you can enter the premises that suits both of you before you write up the final notice of entry letter.
